According to SB76, non-violent felons can return to court after 10 years to have their crimes retried and possibly categorized as a “reduced misdemeanor.”

Exceptions to SB76

Although non-violent crimes can possibly be expunged under this new legislation there are four categories of felony convictions that can’t be reduced

  • Crimes of violence against another person
  • Crimes where the victim was a minor child
  • Crimes involving the use or exhibition of a firearm
  • Possession of a controlled substance with intent to sell or deliver to a minor
